International Arbitration & Mediation Centre at Hyderabad, important step for enhancing ADR landscape of the country, asserts CJI Justice Ramana

The favourable tone set in Indian legal landscape for ADR has no stopping and historically also the same was interwoven. Of recently, Chief Justice of India Justice N.V. Ramana on Saturday said that they can render immense service to the Indian judicial system by preventing matters from going to courts.

Speaking at the inaugural of the international arbitration and mediation centre (IAMC) on its temporary premises at Gachibowli here, CJI Ramana said that arbitration and mediation have a long history in the country, which are now being used for dispute resolutions across the world.

Addressing the inaugural session of International Arbitration and Mediation Centre Hyderabad Curtain Raiser Conclave at HICC Novotel here earlier reported in Telangana Today December 4,2021 issue, Justice Ramana said one should try to resolve disputes through mediation before approaching the courts and stated that solutions could be found in less time through mediation. He said the distribution of assets should be settled amicably by the family members and thus, avoid wasting time running around the courts for years. He emphasised the need for a speedy disposal of pending cases in different courts.

“Mediation was mentioned even in the Mahabharatha. We can bring disputes to an end through mediation and as far as possible, women should mediate to resolve disputes,” he said. He added that Hyderabad was the right place for establishment of the International Arbitration and Mediation Centre.

“I have been quite vocal in my support for such ADR methods. They can either prevent matters from going to courts or in having litigations moved out of courts,” he said.

Chief Minister K. Chandrashekar Rao, who jointly inaugurated the office with Justice Ramana, handed over the keys of two floors at VK Towers in Gachibowli. A permanent structure for IAMC is coming up on five acres of land allotted to it by the state government at Puppalguda. The IAMC has come up with 25,000 sq ft temporary accommodation at VK Towers, an information technology hub.

IAMC got a high-profile case involving former IPL commissioner Lalit Modi and his mother Bina Modi.

Several legal luminaries like Justice Ravindran, Justice Lavu Nageshwar Rao, Justice Hima Kohli, Justice Satish Chandra Sharma, Justice Prashant Kumar Mishra, and ministers were present at the inauguration.

“The setting up of IAMC at Hyderabad is an important step towards enhancing the ADR landscape of the country. While arbitration centres have already been set up in India, most prominently in Delhi and Mumbai, domestic and international parties still appear to prefer to go to foreign countries for dispute resolution,” Ramana said, as he exuded confidence that this trend will change with IAMC at Hyderabad.
