Theme: Confidentiality Obligations & Challenges
The right to a confidential inquiry is one of the cornerstones of the POSH Act. Speaking up about one’s experience of sexual harassment is not easy and employees often hesitate before filing a complaint – What if their colleagues come to know about the proceedings? What if their painful, personal and traumatic experience becomes fodder for gossip on the floor? What if their boss is aware and how might they be affected by this?
In this workshop we will look at what the law says about abiding by confidentiality and what challenges might come in the way of this endeavour. We will discuss best practices on how the IC can conduct a thorough, fair inquiry upholding the principles of natural justice while also being discreet.

Facilitator:
Shweta Bhat is a psychological counsellor with expertise in workplace issues. Having worked and volunteered at various organizations spanning across different industries, she noticed that every industry is plagued by issues around sexual harassment and boundary violations in the workplace. These observations drew her towards conversations about consent, gender equity and appropriate professional behaviour that are emerging as key issues at work, especially in relation to changing cultural influences.
She is part of Internal Committees of various organisations pan India, advising them as an External Member in conducting inquiries into complaints and maintaining safe and inclusive workplaces. She brings a unique perspective to her work with various clients in that she addresses issues not only from a procedural standpoint, but also evaluates the psychological factors underlying the behaviour.
Apart from her work with clients, Shweta has also hosted ‘Voice: The SASHA PoSHcast’, a monthly podcast covering issues relating to the prevention of sexual harassment, workplace equality, and gender. You can learn more about her here.
