CORONIL TRIAL CONTROVERSY

Civil Writ Petition (PIL) has been filed before the Rajasthan High Court alleging misrepresentation on behalf of Patanjali Ayurved Ltd. Lawyers who lead the same Madho Swami (Counsel, Rajasthan High Court) Simranjeet Singh and Mizan Siddiqui from Athena Legal.

The matter titled Sunil Kumar Singh v. State of Rajasthan & Ors was filed as a Civil Writ Petition (PIL) before the Rajasthan High Court alleging misrepresentation on behalf of Patanjali Ayurved Ltd. (Respondent No. 5) in as much as they not having sought approvals for the trials conducted with relation to Coronil tablet.

The Petitioner also alleged that Patanjali was wrongfully advertising the Coronil Tablet as a cure for Covid-19 Coronavirus. The Petitioner sought for issuance of a Writ to ban the medicine launched by Patanjali; to take strict action against Patanjali and to award the cost of the Petition to the Petitioner. The Rajasthan HC was pleased to issue notices to the Respondents vide Order dated 08.07.2020. Subsequently, Patanjali Ayurved Ltd. filed its appearance and further sought time to file a Counter Affidavit.

The Petitioner also argued that an injunction is granted and passed against the Respondents which would effectively prevent Patanjali Ayurved Ltd from advertising Coronil even as a covid management ayurvedic medicine. The counsel for Patanjali Ayurved Ltd vehemently opposed the same and apprised the Court of the e-mail dated 30.06.2020 of the Ministry of Ayush addressed to Patanjali which noted that Divya Pharmacy, Patanjali Research Foundation Trust had initiated necessary activities for the management of Covid-19 appropriately and consequently allowed the distribution of Coronil tablets.

In view of the same, the Hon’ble Court refused to grant an injunction to the Petitioner and posted the matter for further arguments. When the matter was finally listed on 07.01.2021, the Petitioner appeared before the Hon’ble Court and made a submission that he no longer wished to contest the Petition as it had become infructuous in lieu of the Ministry of Ayush e-mail dated 30.06.2020 and consequently withdrew the same. The matter was accordingly disposed of.
