Post poll violence in West Bengal- Gang-raped Victim moves Supreme Court

POINTERS OF THE DEVELOPMENT

1. The Development

The issue of two women, allegedly raped during post-poll violence in West Bengal have moved to the Supreme Court. The applicant has sought permission to be impleaded to safeguard the life and liberty of her family members and seek justice for the crime committed against her body and soul. Not being satisfied with the investigation. The same has been argued in the minor’s application for conducting a fair investigation and sympathising with the applicant.

2. Request for Constitution of SIT

According to both applicants, the interest of justice requires that investigation in the instant case be transferred to a Special Investigation Team or an independent Agency, and the trial to be moved out of West Bengal to prevent any interference or influence.

3. Issue also before Kolkata High Court

On May 25, the apex court had written to the Trinamool Congress government, NHRC, NCPCR, NCW, and the Centre, regarding the violence in West Bengal during and after the elections. On the same day, the TMC government had informed the Supreme Court that a five-judge bench of Calcutta High Court had already taken over this issue.
