Excerpts of Speech

What is the importance of the Constitution? It is treated as “Grundnorm”. It is the instrument of governance. We have in any democratic society limbs of the State-

(a) Parliament/Legislature

(b) Executive

(c) Judiciary

How different organs of the democratic society have to work to produce good governance for the society so that the country progresses. He mentions if you see Preamble itself mentions social, political, economic justice-this is the vision of the Constitution enshrined in Preamble. The three limbs of the State has to maintain a just society, a society in which there is economic justice, social justice for the people of this country.

The Constitution is an instrument of governance. In this scenario, what is the role of the judiciary? Laws are made by the Parliament, enforced by the judiciary but when a dispute arises what is law is decided by the judiciary. The last word has been given to the judiciary. The legislature, of course, has the power to modify the law.

The most important power is the power of judicial review in India i.e. every act of the legislature or executive /administration if challenged, the last word is provided by the judiciary.
