SC grants bail to convict Perarivalan in Rajiv Gandhi assassination case

Supreme Court of IndiaTHE HITAVADA| Supreme Court: THE Supreme Court Wednesday granted bail to A G Perarivalan who has been serving life sentence in the Rajiv Gandhi assassination case, taking note of his long incarceration of over 30 years and no history of complaint when out on parole. A bench comprising Justices L Nageswara Rao and B R Gavai directed the convict, whose death penalty was commuted into life term in 2014, to report to local police station near Chennai in the first week of every month and ordered that the additional conditions for release would be decided by a local court there. “There is no dispute regarding the fact that the applicant has undergone the sentence of 32 years. We are informed by the counsel for the applicant that he was released on parole thrice earlier and there was no complaint about his conduct during his release,” the bench said in its order. It also took note of the submission that the convict is on parole at present as well, and there is sufficient material produced about his conduct during his long incarceration.

SC extends interim relief to Param Bir Singh

Supreme Court of IndiaTHE HITAVADA| Supreme Court: SUPREME Court on Wednesday extended the interim protection from arrest granted to former Mumbai Police Commissioner Param Bir Singh in a case related to the allegations of misconduct and corruption. A bench of Justices SK Kaul and MM Sundresh said that the interim order will continue till March 24. Earlier the top court had directed the Maharashtra Government to completely hold back the ongoing investigation against former Mumbai Police Commissioner Param Bir Singh over the allegations of misconduct and corruption. A bench expressed concern over the “messy state of affairs” highlighted by the ongoing legal battle between Singh with the State administration and said that “it is a very unfortunate situation”.

DB directs for devising mechanism to ensure strict adherence of NDPS Act

THE STATE TIMES| Jammu and Kashmir High Court: A Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Sanjeev Kumar and Justice Mohan Lal, while dismissing an appeal filed by UT against acquittal in NDPS, directed respondents to put a mechanism in place so that provisions of NDPS Act and the rules framed there under are strictly adhered to and Standard Operating Procedure(s) issued by the Home Department vide Circular No. 2-Home of 2017 dated September 25, 2017 and a circular No.01 of 2018 dated November 19, 2018 are strictly followed.

National Lok Adalat across J&K UT on March 12 

THE STATE TIMES| Jammu and Kashmir High Court: For amicable settlement of disputes, J&K Legal Services Authority organized National Lok Adalat across the UT of Jammu & Kashmir was held on Saturday, March 12, 2022. The Persons/Institutions desirous of settling their matters through Lok Adalat were informed to approach the nearest Legal Services Institution for referring their pending or pre-litigation cases to the Lok Adalat for settlement.

Court work to remain suspended today 

THE STATE TIMES| Jammu and Kashmir High Court:  J&K High Court Bar Association, Jammu has decided to suspend work in all the courts on March 5 (Saturday). As per the press note, the decision has been taken in view of the recent incidents of high handedness of police against the members of legal fraternity at the behest of vested interest. “The work in all the courts including High Court, District Court, other Subordinate Courts, Commission and Tribunals shall remain suspended on March 5, 2022,” it stated.
“The members of J&K High Court Bar Association, Jammu to discuss the unwarranted incidents and current prevailing situation concerning the legal fraternity in a meeting to be held on March 5, 2022 at 12.00 Noon in the Bar Library High Court Complex, Jammu,” the handout reads and added “It is requested to all the members of the J&K High Court Bar Association, Jammu to participate in the aforesaid meeting.”

DB seeks fresh comprehensive affidavits regarding slaughter houses

THE STATE TIMES| Jammu and Kashmir High Court: In a much publicized Public Interest Litigation (PIL) filed by an NGO ‘SAVE’ (Save Animal Value Environment) through its Chairperson Devinder Kaur Madaan alias Rumpy Madaan seeking closure of unregulated and unregistered/un-licensed slaughter houses/meat shops in Jammu & Kashmir including both the capital cities, a Division Bench of Jammu & Kashmir High Court comprising Chief Justice Pankaj Mithal and Justice Sindhu Sharma after hearing Adv Sheikh Shakeel Ahmed for PIL, directed Jammu Municipal Corporation (JMC) and Srinagar Municipal Corporation (SMC) to submit a fresh comprehensive affidavit, within two weeks, clearly stating whether existing slaughter houses are to be upgraded, or some new slaughter houses have to be constructed and what is actual state of affairs in respect of both matters.

DB seeks fresh status report regarding policy, requirements of educational institutions in J&K UT

THE STATE TIMES| Jammu and Kashmir High Court: In a Public Interest Litigation filed by All Jammu, Kashmir & Ladakh Teacher Federation seeking directions to administration for framing policy for maintaining student-teacher ratio in schools without any discrimination and implementing the same in letter and spirit, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice Pankaj Mithal and Justice Sindhu Sharma after hearing senior Adv Pranav Kohli with Adv Farhan Mirza for PIL whereas AAG Amit Gupta for UT, granted a months’ time to produce a better status report bringing on record entire policy and needs of educational institutions in Union Territory along with existing student-teacher ratio in both urban and rural areas.
