Legal action against Kamal R Khan- Contempt Proceedings

Kamal R Khan an actor and critic has received a legal notice from Salman Khan’s legal team. According to the online news report, the legal team of Salman Khan explained that the legal notice is not for his review but about his tweets and misleading information about Salman Khan and his foundation Being Human.

Bollywood superstar Salman Khan on Monday filed an application before a court here demanding that contempt action be initiated against actor Kamaal R Khan for continuing to make defamatory remarks despite an undertaking not to do so.

The court heard arguments on the application and posted it for further hearing on June 11.

The application was submitted in a defamation suit filed by Salman seeking to restrain Kamaal R Khan from directly or indirectly making and uploading videos or any other content on the actor, his business ventures and films/projects.

When the defamation suit was heard last month, Kamaal R Khan’s advocate Manoj Gadkari told the court that his client would not make any further defamatory posts or remarks against Salman till the next date of hearing.

Salman had filed a defamation complaint against Kamaal R Khan over the latter’s review of the just-released Hindi film ‘Radhe’. On Monday, Salman’s advocate Pradip Ghandy told Additional Sessions, Judge C V Marathe, that despite the assurance, Kamaal R Khan continued to publish defamatory tweets. An application was then submitted seeking contempt action against Kamaal R Khan.

On Monday, Judge CV Marathe took the Notice of Motion, filed under Order 39 Rule 2A of the Code of Civil Procedure, on record (Consequence of disobedience or breach of injunction). The plea seeks Khan’s detention in civil prison, his physical presence in court, disclosure of all his assets and directions to take down the defamatory content.

The plaint, which seeks for a written unconditional apology to be published by the Defendant on his social media accounts, including his Twitter and Instagram, states that, apart from the video, KRK has repeatedly been making serious allegations against the Plaintiff, his film “Radhe” and his brand “Being Human”.

A Mumbai court, in an interim order, barred Bollywood actor Kamaal R. Khan from posting or publishing “defamatory” content against Salman Khan, his business ventures or movies.

The court, which is hearing a defamation suit filed by the Radhe actor against Kamaal R. Khan, observed that the reputation of a person is of paramount importance and added that any harm to this reputation is tantamount to personal injury.

Salman Khan had sought contempt action against Kamaal R. Khan for continuing to make defamatory remarks against him despite an undertaking not to do so. The plea sought to restrain Kamaal R. Khan from directly or indirectly making and uploading videos or any other content on the actor, his business ventures and films/projects.

The defamation complaint against Kamaal R Khan was over the latter’s review of the movie ‘Radhe’.

In the restraining order, Additional Sessions Judge C.V. Marathe observed that reputation and honour are “no less precious to good men than bodily safety and freedom. In some cases, they may be dearer than life itself.”

After hearing the arguments of both sides, the court observed that the posts by Kamaal R. Khan aim to lower the image of Salman Khan in society, and barred him from posting defamatory content against Salman Khan.
